Jeffrey James Linden was convicted of cocaine possession after police searched his van incident to arrest. At trial, Linden took the stand. In the middle of cross-examination, the prosecutor asked for a side-bar and revealed he received a police report one day earlier that confirmed Linden was arrested in King County for cocaine possession. Linden moved to suppress this report or for mistrial, arguing the State violated discovery rule CrR 4.7 and compelling him to respond to this impeachment evidence could violate his Fifth Amendment rights in the King County matter. But the court granted a recess until the next morning, when Linden testified on redirect that he could not respond to this police report. The jury convicted.
